Terms & Conditions Policy.

The following sections outline the Terms Of Service for UTS Indian Society - DESI ticketing sales and distribution services on www.thedesiaus.com (the “Site”) and other third party sites, the Terms & Conditions Policy also includes the Events & Activities Alcohol Policy. This policy is made under the UTS Indian Society and Affiliated DESI Clubs Constitution and supports compliance with: - Liquor Act (NSW) - The University of Technology Sydney Campus Policy.

Please read these Terms and Conditions carefully before purchasing a ticket. By purchasing a ticket from UTS Indian Society - DESI, you agree to be bound by these Terms and Conditions.

These Terms and Conditions relate both to the sale of tickets and attendance at events/functions. These Terms and Conditions apply to both the original purchaser and any subsequent ticket holders (“you”).

VARIATION TO TERMS AND CONDITIONS

UTS Indian Society - DESI may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.

REFUNDS, EXCHANGES AND REPLACEMENTS

Subject to requests made under the Refundable Tickets Terms and Conditions of Sale below, or the COVID-19 Refunds and Exchanges Terms and Conditions:

UTS Indian Society - DESI will only offer a refund or exchange of a ticket if an event is canceled, rescheduled or significantly relocated by the Seller (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law (including the Australian Consumer Law). You must apply for a refund within a reasonable time. UTS Indian Society - DESI does not offer refunds or exchanges as a result of a change in your personal circumstances;

If an event is canceled, rescheduled or significantly relocated by the Seller, all liability is limited to the amount for which the ticket was purchased (including any fees or charges). Proof of purchase may be required for any refund or exchange. Unless required by law (including the Australian Consumer Law), neither UTS Indian Society - DESI nor the Seller will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses;

UTS Indian Society - DESI will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. UTS Indian Society - DESI may charge a reasonable fee for the replacement of tickets. UTS Indian Society - DESI may not replace tickets where seating is not allocated (general admission tickets);

You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover for any losses in the event of cancellation, rescheduling or relocation;

In most cases, refunds will be automatically processed to the credit card originally used for purchase.

VARIATIONS TO PERFORMANCES OR EVENTS

UTS Indian Society - DESI reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories) and audience capacity.

CONDITIONS OF ENTRY

Admission to an event is subject to UTS Indian Society - DESI's Terms. In particular, the following form part of the terms unless otherwise specified:

You may be denied entry into, or removed from, an event where UTS Indian Society - DESI has reasonable grounds to do so, including if you breach these Terms and Conditions or UTS Indian Society - DESI's Terms, or you are intoxicated, under the influence of illicit drugs, inappropriately attired or adversely affecting the enjoyment of the event by others.

If you arrive late, you may not be admitted until a suitable break in the event.

You may not be permitted to take into the event, or use, cameras or other photographic or recording equipment (excluding mobile phones).

You may be required to submit to a search of your person and/or possessions before entering the event.

CONDITIONS OF ENTRY (CONTINUED)

UTS Indian Society - DESI reserves the right, with reasonable cause, to refuse entry or remove any person without entitlement to a refund, including any person who causes a disturbance or refuses to comply with reasonable requests made by The University.

UTS Indian Society - DESI reserves the right to ask you to present any bags or parcels carried by you for inspection and to ask for proof of purchase or receipt for items carried.

UTS Indian Society - DESI reserves the right to cancel and revoke the tickets of any attendees that are flagged on attendee reporting systems with pending investigation complaints, charges and/or charges, complaints and misconduct allegations that have been filed and reported with the University.

You must comply with any reasonable directions given by UTS Indian Society - DESI and the security arrangements for the event and the venue, which may include searches of clothing and possessions and prohibition of certain items such as knives, umbrellas, glass, illegal items, vehicles or other transportation devices (except as required because of a disability or the aged), alcohol, and items that may cause nuisance or danger.

No animals are permitted within the Precinct or grounds at any time except licensed assistance animals for which such copy license is required to be produced upon request and as certified by law.

All children attending the event must be under the supervision of an adult guardian at all times.

Smoking is not permitted within any of our Event Precincts.

Persons gaining unauthorized access to the event may be liable for prosecution.

UTS Indian Society - DESI reserves the right to cancel, withdraw, postpone, or reschedule any displays or presentations in the event.

COVID-19 SPECIFIC CONDITIONS OF ENTRY

You acknowledge that the event may be scheduled to be held, or will be held, during a time at which one or more Government directions or regulations may be in force regarding the number of persons attending an event (or the holding of the event itself). If that is the case, then the number of persons permitted to be in or around the Venue may be affected, resulting in UTS Indian Society - DESI being required to or deciding to:

cancel or postpone the event; reduce the number of persons who may attend the event; change your seating allocation; and/or change any standing or seating configurations for attendance at the event;

In which case, You may receive a refund in accordance with UTS Indian Society - DESI's Terms and Conditions of Sale or the COVID-19 Refunds and Exchange Terms and Conditions, as the case may be.

You agree to comply with all Government directions, orders, and regulations relevant to attending live events, which may be in place at the time of the event.

If you are attending the event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government, including the Department of Health for the purposes of contact tracing, you must: (a) make the contact details of your group available to the Government (if you have the consent of each group member to do so); or (b) contact each member of your group and request that they provide their contact details to the Government directly.

All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the event, either you or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event. If you do attend the event, you agree to assume all risk associated with COVID-19.

AUTHENTICITY AND VALIDITY OF TICKETS

Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from UTS Indian Society - DESI or other authorized points of sale.

RESALE OF TICKETS & SCALPING

Tickets may not, without the prior written consent of UTS Indian Society - DESI, be resold, transferred, or offered for resale at a premium (including via online auction or other unauthorized resale sites) or used for advertising, promotion, or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold, transferred, or used in breach of this condition, the ticket may be canceled without a refund, and the ticket holder of the ticket may be refused admission. UTS Indian Society - DESI will use reasonable efforts to notify you of such action; however, UTS Indian Society - DESI reserves the right to cancel tickets without a refund with reasonable cause. This decision can only be made by the President of the UTS Indian Society - DESI.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

LIMITATIONS ON NUMBER OF TICKETS PURCHASED

When purchasing tickets for a particular event, you may be limited to a specified number of tickets. If you exceed the stated ticket limit, you may have any or all of your orders and tickets canceled without notice by UTS Indian Society - DESI at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number, or other information. Ticket limits apply to ensure fair access to tickets for fans and as a measure to minimize ticket scalping.

SYSTEM ERRORS

While UTS Indian Society - DESI takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. UTS Indian Society - DESI may cancel an order made as a result of any such error, although in the case of a pricing error, UTS Indian Society - DESI will endeavor to contact you to give you the option of purchasing the ticket at the correct price.

CUSTOMER ERRORS

If an error on your behalf results in UTS Indian Society - DESI reprocessing the ticket transaction at your request, UTS Indian Society - DESI may charge you the actual costs incurred in reprocessing the ticket transaction, including any chargeback or postage fees charged to UTS Indian Society - DESI by a third party.

Alcohol E&A Policy and Guidelines

The following sections outline the Events & Activities Alcohol Policy. This policy is made under the UTS Indian Society and Affiliated DESI Clubs Constitution and supports compliance with: - Liquor Act (NSW) - The University of Technology Sydney Campus Policy. Where relevant or required this policy also supports compliance with guidelines set and administered by the NSW Liquor and Gaming Commission. For clubs carrying the DESI brand by the UTS Indian Society and any newly affiliated clubs and societies that join the DESI Brand this policy must be read in conjunction with the respective universities Clubs and Societies Regulations. In consultation with the President and the General Secretary, we may issue guidelines in relation to the implementation of the following Alcohol Policy.

DESI is committed to the provision of a healthy, safe and supportive environment in relation to alcohol and aims to:

  • Ensure a safe and inclusive environment, free from harassment and social pressure, for all staff and students

  • Promote a culture of responsible use, service and consumption of alcohol, and encourage awareness and support of personal safety and security in relation to alcohol and drinking

  • Discourage opportunities that contribute to risky drinking practices and associated behaviour’s and reduce alcohol-related harm and its impact on DESI and wider communities - Provide support to student representatives, staff and volunteers who wish to address their patterns of alcohol use or other alcohol-related issues. All on and off-campus DESI events where alcohol is to be served and/or sold must be planned, promoted and delivered in a manner that aligns with DESI ’s commitment to the responsible use and service of alcohol.

Expectations Of Student Representatives, Staff & Volunteers.

All event attendees, staff and volunteers have a shared responsibility to support and comply with DESI ’s Alcohol Policy and demonstrate responsible behaviour in relation to alcohol use, service and consumption at all times while performing duties for or on behalf of DESI  or representing DESI , both on and off premises.

This includes but is not limited to:

  • Ensuring they do not attend DESI events if adversely affected or impaired due to the consumption of alcohol. Any attendee, staff member or volunteer who is found to be adversely affected or impaired due to the consumption of alcohol may be requested by DESI to leave the event or workplace immediately until such time that they are no longer impaired

  • Observing all relevant legislation and applicable laws in relation to using, possessing, giving or selling alcohol.

  • Conducting themselves at all times in accordance with the UTS Campus Policy. Where a student representative, staff or volunteer fails to comply with the DESI Alcohol Policy, or their actions or behaviour in relation to the use, service and consumption of alcohol impact the safety or enjoyment of other staff, students or visitors, or risk harm to individuals, property or the reputation of DESI , disciplinary actions as specified by the respective Clubs Constitution, or in the case of staff by the relevant enterprise agreement, may be instituted.

General Regulations for Elections (including voting in ballots)

  1. No member shall have more than one vote.

  2. Voting shall be by secret ballot using the single vote system as described by the UTS Indian Society.

  3. The Election Officer (also the current President of the Union/Club) shall be appointed in accordance with the Constitution for the period of any election, for the purpose of administering the election regulations.

  4. The Election Officer shall be responsible for the conduct of all matters regarding the elections.

  5. The Election Officer shall have the duty to determine and amend the Campaign Rules.

  6. The results of all Union/Club elections shall be certified by the Election Officer and submitted in due course after polling closes.

Social Media Community & Messaging Group Guidelines:

  1. Respect and Inclusivity: Treat all members of the community with respect and kindness, regardless of their background, beliefs, or opinions. Avoid discriminatory or offensive language or behavior.

  2. Constructive Communication: Engage in constructive dialogue and discussions that contribute positively to the community. Provide feedback and express opinions in a respectful manner, fostering a culture of open communication.

  3. Stay Relevant: Keep conversations and posts relevant to the goals and interests of the UTS Indian Society - DESI Community. Avoid spamming, off-topic discussions, or excessive self-promotion.

  4. Mindful Posting: Before posting, consider the potential impact of your words or content on others. Avoid sharing sensitive or controversial topics that may cause discomfort or offense to members of the community.

  5. Intellectual Property and Copyright: Respect intellectual property rights and copyright laws when sharing content. Give proper credit to original creators and obtain permission when necessary.

  6. Maintain Confidentiality: Respect the privacy and confidentiality of others. Avoid sharing personal information or private conversations without consent.

  7. Authority and Moderation: UTS Indian Society - DESI has the authority and reserves the right to remove, delete, alter, and amend any social media interactions, posts, stories, content, and comments posted by the society. The society also reserves the right to remove, delete, and/or censor any comments that may infringe on community guidelines or foster a negative social media environment.

  8. Report Inappropriate Content: If you come across content that violates these guidelines or makes you feel uncomfortable, report it to the moderators/administrators for appropriate action.

  9. Be Responsible: Take responsibility for your own actions and contributions to the community. Help foster a positive and welcoming environment for all members.

By adhering to these guidelines, we can create a supportive and inclusive community on our social media’s and WhatsApp Communities where all members feel valued and respected. These guidelines are in addition to existing UTS Code of Conducts and NSW State and Federal Legislature.
